Healerverse Terms of Service

To level up global collective consciousness by dissolving barriers with unity through healing and transformation of the mind, body, and spirit

Healerverse is the ultimate place for seekers to find healers, healing and a community. We strive to provide a unique decentralized social media experience, which allows Seekers, Healers and Organizations to post, share stories, explore Healers, personalize their pages, and send and receive messages

Healerverse strives to be the digital community of choice for its Seekers and Healers. Our mission is to foster social connections in a fun and easy to navigate online community. We strive to maintain the strongest level of values, including being a customer-centric company which provides quality services and support to our Seekers and helps them develop and nurture important personal relationships online and also find Healers to provide different services to them all via the Healerverse platform.

→ Agreement

• Healerverse is owned, supported, and operated by Healerverse LLC (hereinafter referred to as “Healerverse,” “us,” or “we”). These Terms of Service govern Your use of Healerverse and the related products, features, applications, services, technologies, and software that we offer.
• You agree that by signing up for a Healerverse account and, accessing and using our services, to enter into a legally binding Agreement with Healerverse, the Terms of which are outlined here in these Terms of Service, and include any additional Terms and Policies, such as Our Privacy Policy, referenced to herein.
If You do not want to enter into this Agreement or to be bound by these Terms of Service, then do not sign up for a Healerverse account.
• If You already have a Healerverse account and wish to terminate this Your account and this Agreement, You may do so at any time by deleting Your account, and no longer accessing or using our services. If You delete Your account, the Termination provision contained below will apply to any final issues regarding the closing of Your account and any issues related to Your booked Healer Services, Events and Workshops.

→ Definitions

a. “Content” means any information or data that is uploaded by a Seeker onto the Platform.

b. “Content Standards” means the Healerverse Community Content Standards.

c. “Healer” means a duly licensed business or an individual that has a Verified Healer Account on the Healerverse Platform.

d. “Personal Information” means any information relating to an identified or identifiable individual that is collected via our Website. Personal Information may include a Seeker’s: full name, physical address, email address, IP address, or other identifier such as from a Cookie. Personal Information does not include any aggregate or anonymized data that may have been created from Personal Information but can no longer be used to identify, relate to, or could reasonably be linked to a Seeker.

e. “Platform” means the Healerverse website available at: www.5dhealerverse.com>.

f. “Seeker” means a natural person, over the age of 16, who has a valid Healerverse account.

g. “Services” means the support, infrastructure, and general site services offered by Healerverse.

h. “You” or “Your” means Seekers.

• The Services that We provide
  Healerverse is a social media platform that provides its Healers, Seekers and Organizations with a SACRED space to post information about themselves or topics of interest, interact with other Seekers in various ways, and to explore, connect, and book/purchase services, events and workshops with Healers and Organizations. The Healerverse platform is meant to foster individual expression and a dynamic online community.
• Who can use the Services
  At this time, We are only offering Our services to natural persons, over the age of 16. We do not offer or market any of Our services to children under the age of 16, and have no plans to in the future.
• How to Create Healerverse account
  Go to www.5dhealerverse.com> and follow the instructions on how to set up and create Your Healerverse account. As noted above, by creating and using a Healerverse account You are agreeing to enter into this Agreement, consenting to these Terms of Service and any related policies such as Our Privacy Policy. You are also agreeing to abide by and comply with our Content Standards.
• What You can do and share on Healerverse
  Seekers can post various Content on their Healerverse page, such as photos, stories, status updates, and videos. All Content must comply with and meet Our Content Standards and cannot violate these Terms of Service or any related policies, such as Our Privacy Policy. Any Content that is in violation of our Content Standards or these Terms and Conditions will be removed. Repeated violations may result in a Seeker having their account restricted (i.e. losing the ability to post and book services with Healers) and/or the suspension or termination of the Seekers account. Healerverse will make these determinations in its sole discretion. The only thing you’re not allowed to do on here is cause arguments with others. We promote unity, love and support on our platform. We aim to give the community a place to share their unique experiences and express themselves as they would like.
• Public Posts
  We encourage all Seekers to take advantage of our privacy controls, which allows Seekers to manage who can connect with them, what other Seekers can see and do with posted content, and how to limit Seekers’ Personal Information from being accessed or shared. However, Healerverse is a social media platform that is meant for public interaction and sharing. Thus, by signing up for a Healerverse account and posting Your Content through it, You are voluntarily putting that Content into the public sphere. We encourage all Seekers to be mindful of the repercussions and potential issues with publicly sharing any Content, but especially Content that contains sensitive or Personal Information.
• Your Obligations with Your Account
  As a Seeker You agree to:

  1. use a strong password and keep it confidential;

  2. not transfer or sell any part of or access to Your account to a third- party;

  3. abide by and comply with Our Content Standards; and

  4. not use Your account for any harassing, fraudulent or illegal purposes.You also agree to notify us as soon as possible if Your account is hacked, taken over by an unauthorized person, and/or there is Content posted that You did not post or messages sent to other Seekers that You did not create and send. Please email support@5dhealerverse.com>, so we can help.

• How Our services are funded
  When You book an appointment with a Healer for their services, we receive a small percentage of the total fee and via our subscription fees for Verified Healers, (coming soon when we have appointments on the platform.) Additionally, we earn money by allowing advertisers place advertisements on Healerverse and in our Newsletter in order to advertise to our Seekers, Healers and Organizations. Healers and Organizations pay a monthly or annual subscription fee to use our SAAS system, sell event tickets, and workshops on our platform.
• Permissions and Licenses
• License to use Content You post, share or create:As between You and Healerverse, You own the Content and information that You submit, create or Post to the Platform and any related services. You grant Healerverse and our affiliates a worldwide, transferable and sublicensable right to host, use, copy, modify, distribute, publish, publicly perform or display, translate, create derivative works of, and process, any of the information or Content that You have provided or posted to the Platform and any related services. This license is provided without any further notice or compensation to You or others. We would do this to help market you, your events, workshops and posts on external platforms. We love to market our community and we do so with good intentions to get exposure for our users.
• Permission to use Your name, profile picture, and information aboutYour actions with ads and sponsored content: You give us permission to use Your name and profile picture and information about how You interact with the Healerverse platform and app, and the overall Healerverse community, including actions You have taken with regards to any ads, offers and other sponsored content that we display on the Platform and related services, without any compensation to You. We do so with the best intentions of giving you exposure, because we’re grateful you are part of our community! You can control what ads You see and how Your Personal Information is shared with third-parties in Your account settings. For more information on how to use these controls, please refer to section regarding Privacy Settings.
• Permission to update Software: If You download software from us, such as the Platform, You give us permission to download and install updates to such software when and where available. We are always doing platform improvement on a daily basis.
• Permission to receive messages and notices:Unless You have specifically blocked another Healer, Seeker, or Organization, other Healers and Seekers will have the ability to message You directly via the Platform. You consent to receive such messages but can at any time block users from directly messaging You. For more information on how to block another Seeker please see section in Privacy Settings. In addition to other Seekers, we may send You notices from time to time, about different subjects related to the Platform or related services, and/or more specifically about Your individual account. You consent to receive these notices and notifications from us. You can manage your notifications on the platform under Your “Settings” and “Notifications” tab when logged in to our portal.
• Using Healerverse Intellectual Property
  If You use content that is covered by any Intellectual Property rights that we have and have made available to You and other Seekers via the Platform or other services, we retain all rights to that content. You can only use our copyrights or trademarks (or similar marks) as expressly permitted by us in writing. You must obtain our prior written permission to modify, create derivative works of, decompile, or otherwise attempt to extract source code from us.
• Automated Processing
  We use the information and data that You provide, Your activity on Healerverse, and information about other Seekers, to make recommendations to You for connections, ads, products, events, and other Content, that You may find interesting or useful. Please keep in mind that we do this with the best intentions and want to support you and the community. Please email support@5dhealerverse.com> for suggestions of what we can do better. WE are here for YOU.
• Service availability
  Healerverse’s Platform and other services may be changed, suspended, or discontinued at any time. We cannot guarantee that the services will always function, be safe and secure, or error free, or that they will function without disruptions, delays, or imperfections. We do not control and are responsible for any issues with Your internet access or service, which is required in order to access Your account on Healerverse. We may also need to perform maintenance that requires shutting down our Platform or other services, from time to time, and thus, our services will not be available to You during those times. We make no promises to store or keep hosting any information or Content that You have posted. Healerverse is not a storage service and has no responsibility to store Your information or Content, except as may be required by applicable law and as noted in Our Privacy Policy.
• Ability to limit service/account and its Functions
  Healerverse reserves the right to limit Your use of the services and Platform, including the number of Your connections, Your ability to post Content and Your ability to message other Seekers. Healerverse also reserves the right to restrict, suspend, or terminate Your account if You breach this Agreement, are misusing the services, violate Our Content Standards, or violate any law. Be nice to others and that’s what we ask. Unity and love is the foundation of our mission.
• Inaccurate or Harmful information
  By using Healerverse, You may encounter Content or information that might be inaccurate, incomplete, delayed, misleading, illegal, offensive, disturbing, or otherwise harmful. While we do our best to enforce our Content Standards and remove such Content when we become aware of it, Healerverse does not generally review Seekers’ Content and You acknowledge and agree that we are not responsible for any such Content misuse. There is also a risk that You may be mistakenly associated with such Content or the Seeker(s) who posted it. You acknowledge this risk and agree that we are also not responsible if You are associated with such Content or Seeker(s). Realistically, we just want to protect everyone. We’re not like other platforms and aren’t striving to censor or shadow ban anything, so be mindful and we will be, as well. We take no stance on medical information, just that everyone take all the information and make good decisions for themselves.
• Data Security
  We take data security seriously and do our best to protect Your data and Personal Information. We utilize commercially available data security safeguards, such as a firewall and multi-factor authentication, to secure access to our systems and the data stored in them. We rely on You to do Your part as well by using a complex password and keeping access to it safe. We also cannot protect data, including Your Personal Information, that You post publicly via Your Healerverse account or any other social media account You may use. Despite our best efforts, however, here is no way to completely eliminate the risk of a data security incident. If we do suffer one that affects any of Your Personal Information, we will report the same to You as per applicable data breach notification laws.
• Seeker Safety
  We prioritize making the Healerverse community a safe and fun environment for all Seekers. We do our best to offer different privacy settings and controls to give Seekers control over the public nature of their accounts and activity. We also strive to enforce our Content Standards and to remove any harmful, harassing, threatening or dangerous material. Be nice to others and all will be well. We urge Seekers and Healers to be mindful of the Content they post and upload through their accounts, not only that it be in compliance with our Content Standards, but also for Seekers own personal safety. We also suggest that Seekers be careful about giving out personal information to any other Seekers or posting the same publicly via their account. We also remind Seekers of the potential dangers of meeting another Seeker or Healer in the real world and caution Seekers to carefully consider such “real life” meetings. Although, we provide privacy controls for our Seekers, if You decide to post or upload any sensitive or Personal Information to Healerverse, and it does not violate our Content Standards, we will not take any action to remove or restrict access to such information.
• Legal
  
• No Warranty
  Healerverse and its affiliates make no representation or Warranty About The Services, Including Any Representation that the services will be uninterrupted or Error-free, and provide the services (including any Content and information) on an “as is” and “as available” Basis. To the fullest extent permitted under applicable Law, Healerverse and its affiliates disclaim any representations or warranties of any kind, express or Implied, including without limitation, implied warranties Of merchantability, fitness for a particular purpose, Implied warrant of title, accuracy of data, non- Infringement of intellectual property or any implied Warranty arising from statute, course of dealing, course Of performance, or usage or trade. Without limiting the generality of the foregoing, Healerverse has no obligation to indemnify, defend, or Hold harmless any seeker or healer, including without Limitation against claims related to injury, product Liability or infringement of intellectual property rights.
• Limits on Liability
  To the fullest extent permitted by law, in no event will Healerverse, its affiliates, or its or their respective Directors, Officers, Employees, Representatives, Consultants, agents, suppliers, or licensors be liable for Any direct, indirect, special, incidental, exemplary, Punitive, or consequential loss or damage, or any other Loss or damage of any kind, arising out of or in connection With the platform, healer’s services or your use of or Inability to use the platform (including the input of Personally identifiable and other information into the Platform), whether the claim is based in contract, tort (including negligence), strict liability, warranty, or Otherwise, and even if Healerverse has express knowledge Of the possibility of the loss or damage. Your sole and Exclusive remedy is to stop accessing and using the Platform. Without limiting the foregoing, in no event will Healerverse's liability to you exceed $100, even if this Remedy fails of its essential purpose. Some jurisdictions do Not allow the exclusion or limitation of certain damages, So some of the above exclusions and limitations may not Apply to you. If you are a California resident, you waive California civil Code section 1542 (as may be amended), which provides: “a General release does not extend to claims that the Creditor or the releasing party does not know or suspect To exist in his or her favor at the time of executing the Release and that, if known by him or her, would have Materially affected his or her settlement with the Debtor or released party.” if you are a resident of another jurisdiction, you waive any comparable statute Or doctrine. Additionally, we are not responsible for what Seekers post, share, upload, say, and/or message on the Healerverse platform. We are also not responsible for internet service providers and how their action, inaction, or unavailability may affect Your use of the services. When you book a service with a Healer, we are not liable for Healer’s provision of services, including anything that the Healer does, tries to do, or fails to do with regards to their services. To the fullest extent permitted by applicable law and under no circumstances, will we be liable to any Seeker for any lost profits, revenues, information, content or data, damage to reputation, or any indirect, incidental, consequential, special or punitive damages.
• Healer Services and related Health Care Services Disclaimer
  Healerverse does not provide Healer Services nor are we are not a medical or health care services provider or lab services provider and do not provide medical or health care or lab services or advice including, but not limited to, emergency or urgent medical services. None of the Platform content should be considered medical advice or an endorsement, representation, or warranty that any particular Healer Service or Healer is safe or effective, for You. Healerverse does not practice medicine or any other licensed profession, and does not interfere with the practice of medicine or any other licensed profession by health care professionals which may include certain Healers that are advertising their services on Healerverse, each of whom is responsible for his or her services and compliance with the requirements applicable to his or her profession and license. Neither Healerverse nor any third parties who promote the Platform or provide you with a link to the Platform to book Healer Services shall be liable for any advice or treatment you obtain from a Healer and are not responsible for any reliance or non-reliance on any information receive from the Healer related to the Healer Services, including but not limited to medical or alleged medical advice.
• Governing Law and Disputes
  For any claim, cause of action, or dispute that You have against us that arises out of or relates to these Terms of Service, the Healerverse Platform or other services, or any of our other policies, such as our Privacy Policy (“Your Claim”), You agree that it will be resolved exclusively in the U.S. District Court for the Southern District of Florida or a state court located in Palm Beach County, Florida. You also agree to submit to the personal jurisdiction of either of these courts, for the purpose of litigating Your Claim, and that the laws of the State of Florida will govern these Terms and any Claim, without regard to conflict of law provisions.

→ Account Cancellation, Suspension or Termination

• Healerverse reserves the right to cancel, suspend, or terminate your account as needed it its sole discretion. If Your Content or messages to other Seekers on the Platform violate our Community Content Standards, then we may give you a warning about the offending Content and another chance to abide by the rules, but we are under no obligation to do so and may just immediately take action as well if we decide in our sole discretion that such action is necessary. You can contact us about any actions taken with your account here: support@5dhealerverse.com> and we may provide you with a chance to appeal or reverse the decision, but such second chance is completely within our sole discretion and You are not entitled to the same.

→ Entire Agreement

• These Terms and Conditions make up the entire agreement between You and Healerverse, regarding Your use of the Healerverse platform and application, including any additional products and services related to the same. These Terms and Conditions superseded any other Agreement You may have had with Healerverse and can only be modified or changed in writing signed by both Healerverse and You.

→ Supplemental Terms

• Severability
  If any portion of these Terms of Service are found to be unenforceable, the remaining portion will remain in full force and effect.
• Transfer Rights
  You cannot transfer any of Your rights or obligations under these Terms of Service to anyone else without Our written consent. All of Our rights and obligations under these Terms of Service are freely assignable by Us in connection with a merger, acquisition, or sale of assets, either by operation of law or otherwise.
• Estate Issues/Death of Seeker or User
  You can designate someone (called a “Healerverse Estate Contact”) to gain access to Your account should You die or become incapacitated. Only the Healerverse Estate Contact or a person who You have designated in Your valid Will or similar legal document that expresses a clear consent to take possession over Your account in the event You die or become incapacitated, will be able to gain access to Your account in such a situation.
• Suggestions are Not Compensable
  We welcome and appreciate Your feedback and suggestions. But if You send the same to us, we reserve the right to use the same freely without any restrictions, 1credit to You, or compensation to You. Additionally, We are under no obligation to keep any such suggestions confidential.
• No Third Party Beneficiaries
  These Terms of Service are not meant to create and do not create or confer any third-party beneficiary rights.
• Waiver of Rights
  We reserve the right to not enforce a portion or the entirety of these Terms of Service and any related policy, as we see fit in our discretion. Such a failure to enforce these Terms of Service or any other policy shall not be held to be a waiver of any kind. Any amendment to or waiver of these Terms of Service or any related policy must be in writing and signed by us.

Changes to the Terms of Service

• We may make changes to these Terms of Service, and the related policies, including our Privacy Policy, as needed from time to time. We will post any changes here and if they are significant changes that may affect Your Privacy or Your use of the Platform, we will provide You notice either via Your account, conspicuously on these Terms of Service, or by other means. If You object to any changes, You may delete Your account.
